THE GENERAL DIRECTOR OF SAIGON PORT

  • Pursuant to the Price Ordinance No.40/2002/PL-UBTVQH10 dated 26/04/2002
  • Pursuant to the Government’s decree  No.170/2003/ND-CP dated 25/12/2003, detailing the implementation of some provisions of the Pricing Ordinance
  • Pursuant to the Government’s decree No. 75/2008/ND-CP dated 09/06/2008, revising and supplementing the Government’s decree No. 170/2003/ND-CP dated 25/12/2003
  • Pursuant to the circular No.104/2008/TT-BTC dated 13/11/2008 issued by Ministry of Finance, instructing the implementation of the decree 170/2003/ND-CP 25/12/2008 and the decree 75/2008/ND-CP 09/06/2008
  • Pursuant to the decision No.886/QD-TCCB-LD dated 12/05/1993 of the Ministry of Communications and Transport, on the establishment of the State Enterprise
  • To ensure the balance between the current seaport service charges and the practical fluctuation of the market

 

DECIDES:

Article 1: Now promulgate together with this decision: the Saigon Port’s Table of Seaport Service Charges, being collected in foreign currency (USD)
Article 2: Subjects for the application of this decision include:

  • Ships operating in the transportation of cargoes (including container), passengers from Vietnam to foreign countries and vice versa, transit – Vietnam transportation, international transshipment, foreign military and training ships entering, leaving or mooring at Saigon Port.
  • The seaport service charges of imported and exported cargoes (including containers), transit or transshipment cargoes will be paid by the carriers or those who are authorized by the carriers.
  • Passengers (including officers and crew members of passenger ships); officers, seafarers of military and training vessels from abroad to Vietnam or vice versa

Article 3: The rates prescribed in the tariff of the Saigon Port are not inclusive of VAT
Article 4: the Saigon Port’s functional departments are under obligation to inform cargo owners, ship owners and related parties about this decision for timely payment. The related units belonging to the Saigon Port base on this decision to collect service fees correctly and accurately.
Article 5: This decision becomes effective from 01/01/2009. The previous decisions contrary to this decision are to be canceled.

SAIGON PORT’S TABLE OF SEAPORT SERVICE CHARGES
(CHARGES ARE QUOTED IN U.S. DOLLARS)

Being promulgated under the decision No. 1588/2008/QD dated 15/12/2008 by the General Director of Saigon Port

I – GENERAL PROVISIONS

1/ Subjects for application

    • Ships transporting passengers, cargoes (including containers) from Vietnam to abroad and vice versa, transit – Vietnam transportation, international transshipment transportation (referred to international transportation); foreign military and training vessels entering, leaving or mooring at wharves/buoy berths under the management of Saigon Port or requiring Saigon Port’s services.
    • The service charges of imported and exported cargoes, transit or international transshipment cargoes, coming in or out export processing zones will be paid by the carriers or those who are authorized by the carriers.
    • Passengers (including crew members, officers of passenger ships or military and training ships) from abroad to Vietnam by sea or vice versa.

2/ Working time:

  • Administrative working time: 7:30 am to 4:30 pm
  • Workers’ cargo handling time: consecutive (including Sunday, holidays and Vietnamese New Year days)

3/ Unit of seaport service charges and round – up method:
Unit price of seaport service charges is calculated based on the gross tonnage (GT); main engine capacity is calculated in horse power (HP) or KWAT (KW) of ships; time is calculated in hour or day; cargo volume is calculated in ton (T) or cubic meter; containers are calculated in unit (cont); specifically:

3.1 The tonnage unit:
3.1.1 For dry carries (including containers); liquid cargo tankers; passenger ships, training ships; in/out ships for repair or dismantlement : the tonnage for calculating service fees is the maximum tonnage (GT) inscribed in the Registration Certificate; decimals less than 0.5 are ignored, from 0.5 GT to less than 1 GT is rounded to 1 GT.
3.1.2 For military ships: the tonnage for calculating seaport service charges is equal to 200% of the maximum tonnage inscribed in the Certificate of Registration.
3.1.3 For ships without GT inscription: the tonnage for calculating seaport service charges is converted as follows:

  • Cargo ships: 1.5 ton of registered tonnage is equal to 1 GT
  • Tug boats, push boats: 1 HP is equal to 0.5 GT
  • Barges: 1 ton of registered tonnage is equal to 1 GT

3.1.4 For ships being a convoy of barges, tug boats (push boats): the tonnage for calculating seaport service charges is the total GT of the whole convoy of barges and tug boats (or push boats).

3.2 The engine capacity unit: is the horse power (HP) or KW; decimals less than 01 HP (or KW) shall be rounded up to 01 HP (or KW)

3.3 Weight unit or cargo volume:

  • Shall be ton (T) or cubic meter, the decimals less than 0.5 T or 0.5 m3 are not calculated, from 0.5 T or 0.5 m3 or more than shall be rounded up to 1 T or 1 m3
  • For one single bill of lading, the minimum volume for calculating service charges is 1T or 1 m3
  • The tonnage for calculating seaport service charges is the tonnage of cargoes inclusive of wrapping or packing
  • For cargoes of which each ton occupies 2m3 or more, every 2m3 is calculated as 1 ton.

3.4 Time unit

  • For time unit being day: one day is calculated with 24 hours, the odd part of a day (less than or equal 12 hours) shall be calculated as ½ day, more than 12 hours but less than 24 hours shall be rounded up to one day.
  • For time unit being hour: 1 hour is calculated as 60 minutes, the amount being equal or less than 30 minutes shall be calculated as ½ hour, the amount being over 30 minutes but less than 60 minutes shall be rounded up to 1 hour.
  • A shift is calculated equal to 8 hours, ½ shift is calculated similar to 4 hours.

3.5 Currency unit for calculating seaport service charges:
US dollar (USD) shall be collected. The payment of seaport service charges shall be compliant with the Vietnamese State’s current regulations on foreign currency management. In cases of changing from US dollar to Vietnam dong, the conversion shall be made at the average exchange rate on the inter-bank foreign currency market announced by the State Bank of Vietnam at the time of payment.
The rates prescribed in the Table of Seaport Service Charges are not inclusive of VAT.

 

 

 

II – CHARGES ON WHARFAGE AND MARINE SERVICES

1/ Rates for use wharves, mooring buoys in the port areas:

1.1 Applied for transport means:

1.1.1 Ship berthing at wharf or anchoring at buoy shall pay wharfage at rates as follows:

  • At wharf: 0,0031 USD/GT – Hour
  • At buoy:  0,0013 USD/ GT – Hour

1.1.2  In the case of using more idle wharf for safe corridor: 500 USD/100m wharf – day

1.1.3 In the case of ship berthing at many places within the port area: the wharfage shall be totally calculated on actual time and rate at each berth.

1.1.4 In case a ship disregarding the order of leaving the port continues to occupy wharves or buoys, wharfage shall be charged at the following rates:
- Occupying of wharf:                                                   0,006 USD / GT – hour
- Occupying of buoy:                                                    0,002 USD / GT – hour

1.1.5 Minimum charges:

- For ships having tonnage ≤ 200 GT:

  • At wharf:                                              15 USD / day – time
  • At buoy:                                               10 USD / day – time

- For ships having tonnage > 200 GT:

  • At wharf:                                              20 USD / day – time
  • At buoy:                                               15 USD / day – time

1.1.6 For ships berthing alongside another ship at wharf: 0,0015 USD / GT – hour

1.1.7 In the case of not being able to handle cargoes due to weather condition for more than 01 day (24 consecutive hours) or a ship has to give up its berth for another ship at the order of the port authority, wharfage shall be exempted for the period of no handling.

1.2 Applied for passengers

(Passengers include crew members and officers of passenger ships or seafarers, officers of military and training ships)

1.2.1 Passengers passing through the wharf/berth (on arrival or departure) shall be charged as the following rates:

  • On entry:                                                    2 USD / person
  • On exit:                                                      2 USD / person

(Children under 12 years old shall not be charged)

1.2.2 In case a ship berthing at the anchorage area is allowed to use other facilities to transport passengers to shore for sightseeing, the wharfage shall be charged as 2 USD / person (including both entry and exit)

2/ Charges on tugboat assistances
2.1 Ships using tugboat assistances for entering into or departing from wharves/buoy berths under the management of Saigon port shall be charged as the following rates:

The above rates being applied for any time of the day (no additional charges for Sunday, holidays and Vietnamese New Year days)

2.2 Special cases:

  • Increasing 30% of the rate in 2.1:
    - Ship shifting among wharves/buoys of Saigon port (on the Saigon river)
    - Ship shifting from Saigon port’s wharves/buoys to (on the Saigon river) to wharves/buoys of Ben Nghe port, Tan Thuan Dong port or vice versa.
    - Ship shifting from wharves/buoys of Lotus port / Rau qua port to Tan Thuan 2 port or vice versa.
  • Increaing 50% of the rate in 2.1:
    - Ship shifting between Saigon port’s wharves/buoys and other ports’ wharves/buoys on the Saigon river.
    - Tugboat assistance to escort ships from the nautical No.4 to wharves / buoys on the Saigon river or vice versa under the pilot’s requirement.
  • Increasing 120% of the rate in 2.1: shifting between buoys in the Nha Be area and wharves/buoys in the area of Saigon river.
  • Shifting in case of ship agents changing: being charged as one time of entering (or departing from) the port.
  • If the tugboat has already arrived the meeting place by order of ship agents but the ship has not arrived or does not arrive on time or not departure or change tugboat under the pilot’s requirement, the ship shall be charged 50% of the rate in 2.1
  • Rates have to reach an agreement between the tugboat company and ship owners (ship agents) in the following cases:
    - Ship’s main engine is not working, having to use tugboats for pushing or towing
    - Tugboats services for ship entering/departing/shifting between wharves/buoys not under the management of Saigon Port; or ship owners require tugboat assistance in the areas not being mentioned above; or serving ships entering/leaving dry-dock for repair.
    - Tugboat assistance in case of salvation, wind force from 7 degree.

4/ Charges on canoe hiring: 
See off and pick up workers, passengers USD30/hour

5/ Charges on fresh water supply: (including facilities costs serving for water supply)
Providing fresh water as the ship’s requirement and collecting fees as follows:

  • By water pipelines from wharf: USD 2.80/m3
  • By waterway transport means: USD 3.50/m3

6/ Charges on dumping services:
Ships berthing at wharves or buoys have to empty the rubbish one time in every 3 days; the first dumping service shall be done upon ship arrival at wharves/buoys. The rates are as follows:
6.1 For cargo ships:

6.2 For passenger ships, military and training vessels
- At wharf                                                                          : USD 0.70 / individual
- Minimum rate for one time of dumping garbage           : USD 100 / time-ship
- Maximum rate for one time of dumping garbage          : USD 500 / time – ship
- At buoys, bay or wharf but waterway transport means have to be used for dumping garbage: the rate is 130% of the rate applied for ship berthing at wharf.
6.3 Special cases:
- If ships carrying cargoes or passengers use garbage disposal facilities before requiring dumping service, the rate for dumping service is 50% of the rate in 6.1 and 6.2
- In case garbage has to be destroyed (burned, buried…) as the requirement of ship owners or quarantine authority, the rate for dumping services shall be agreed between the director of dumping service company and its customers.

7/ Charges on opening, closing hatch:
Shipowners requiring the port’s workers to open and close ship’s hatches have to pay the rate as follows:

7.2 Using the port’s cranes: 100% of the rate in 7.1. The rate will be negotiated if floating cranes are used.
7.3 For ships having double deck: 150% of the rate in 7.1

8/ Charges on other services:
When shipowners ask the port provide workers to do the following services:

  • Cleaning cargo storages
  • Sweeping, washing ship’s deck
  • Lashing cargoes
  • Other services not being mentioned above

The port and shipowners will negotiate the rate for the services

  

 

III – CHARGES ON CARGO, CONTAINER HANDLING

1/ Charges on handling cargoes:

1.1
Cargo groups:

Group 1: All kind of cargoes in bulk
All kinds of ore, cement, clinker, plaster, brimstone, fertilizer, food, salt, sugar in bulk, shavings, macadam, stone powder, soil, sand, coal…in bulk
Group 2: Cargoes in bags (except kinds of cargo mentioned in group 5)
Group 3: All kinds of metal in bundles, packages, construction iron, mild iron, bar metals, cast iron, steel sheet, iron sheet, waterpipes, metal bars in bulk, other completed metal products….
Group 4: machinery, equipments, cargoes in packages, cases, pallet such as: fire brick, woodpulp, rubber, bale of cotton, bale of paper…cargoes in tanks, drums, cans such as: petrol, oil, grease, paint, asphalt, calcium carbide, insecticide, chemicals…Plank, round wood, sawn timber, bamboos…in bundles, packages with length ≤ 12 m (not include factors mentioned in group 6)
Group 5: all kinds of cargoes like general cargoes, sundry goods, handicrafts, polyethylene, white candle, all kinks of rubber (except rubber packed in pallets); food and industrial cargoes in all kinds of packages (except uncommon cargoes as specify detailed): household effects, sport appliances, stationary, paper in rolls, wood-pulp, cotton, textiles, fibre, paper-bags, all kinds of animal feather, incense, ceramics, soap, canned food, peppercorn, tea, coffee, cigarettes, good.

    • Products made of enameled tile, terracotta, ceramics, glass, plastic, polyethylene, briquette.
    • All kinds of medicament, live animals, fresh fruits and vegetables, bee’s honey, ornamental plants.

Group 6:

    • Bulky/heavy cargoes packed or bared such as: conveyor belts, girder, boilers, turbine, housing frames and cargoes satisfying one of the following factors: weight of above 20 ton to 30 ton or having the length of above 12 m to 15 m; the width of 2.5 m to 3.5 m; the height of 2.5 to under 3.5 m.
    • Valued cargoes such as: ginseng and buidding antler, all kinds of foreign wine, canned beer, foreign cigarettes, bird’s nests
    • Crystals, sophisticated devices: television, electronic machinery, cinema projectors, medical machinery and instruments.

Group 7: all kinds of transportation means (from 30 ton and under)

  • Other kinds of cargoes not being mentioned above are based on quality, packaging methods, handling capacity to classify into equivalent group.

Ship – Warehouse / Storage yard: the rate is equal to the total of rates of projects (including transportation rates within the port areas)

Notes:

- Cargo handling at buoys                                             : increasing 10% of the rates in 1.2
- Cargo handling at Nha Be area                                   : increasing 30% of the rates in 1.2
- Cargo handling at Thieng Lieng area                           : increasing 50% of the rates in 1.2
- Cargoes packed in big bags – Jumbo bags(group 2): decreasing 10% of the rates in 1.2
- In case ships having no cranes or ship-owners require using the port’s cranes, besides the rates in 1.2, charges on crane hiring prescribed in III-7.2 of this pricing table will be collected.
- For special cargoes with high values not included in group 6, the rates of handling will be agreed by the Port and its customers (the minimum rate shall have to be more than 110% of the rates applied for group 6)
- In case of using ship gears for handling cargoes and done by crew members on board and the port’s workers undertake works at wharf side only, 70% of the rates prescribed for the mode of ship’s holds – truck/barge or vice versa will be applied.

1.3 Cases for additional charges:
- For cargoes in bags such as: fertilizer, plaster, chemicals, light powder, heavy powder, talcum, soda ash: increasing 20% of the rates in 1.2
- Smelly, dirty and dusty cargoes: cement, coal, ore, dried shrimp, fish sauce, animal bones, dried fish, fresh rubber, soda ash…: increase 30% of the rates in 1.2
- Abetos, rice bran, tapioca, soda, insecticide, caustic soda, sulfur, cargoes with the nature of acid, gas, inflammable such as: petrol, oil, alcohol, ammoniac…; cargoes difficult for handling like: clay…: increase 50% of the rates in 1.2
- Steel, iron scraps in bulk, pig-iron ingot, stones, cargoes in bags having to be cut for stowage: negotiable price
- For cargoes pressed, blocked…having to be split for loading/unloading: increase 100% of the rates for the volume of cargoes breaking.
- For cargoes being unstuffed from container: increase 50% the rates in 1.2
- For cargoes from ship rescued, damaged cargoes, cargoes not-in-order stowed, dangerous cargoes, explosive, flammable and toxic chemicals: Nitrates, Nitrocompound, Alkalies, Methane, Magnesium, Nitro cellulose and other products derived from these substances: increase 100% of the rates in 1.2
- For cargoes handling, shifting in the same hold: 50% of the rates applied for the mode of ship’s hold – truck/barge (or vice versa)
- For cargoes handling, shifting from one hold to another hole in the same ship without passing wharf: 70% of the rates for the mode of ship’s hold – truck/barge (or vice versa). In case of passing through wharf: 150% of the rates for the mode of ship’s hold – truck/barge (or vice versa).
- For cargoes handling, shifting from one ship to another ship alongside: increase 30% of the rates for the mode of ship’s hold – truck/barge (or vice versa)
- For cargoes handling, shifting from barge, boat, or ship onto truck transported to load on board of another ship (or vice versa): the rates are charged based on stages done in reality (charges on crane hiring is added)
- For frozen cargoes (15oC to 0oC): increase 50% of the rates in 1.2; frozen cargoes (under 0oC): increase 100% the rates in 1.2
- In case of cargoes with many factors for increasing rates, only highest percentage increase will be applied.
- Other cases not being mentioned above: agreed rates.

1.4 Charges on weighing cargoes
- By motor scale:
+ Cargoes and means of transportation: USD 0.50/ton (applied only for truck with cargoes)
+ Only cargoes:  USD 1/ton
- By manual scale: 60% of the rates of cargo handling charges

1.5 Charges on handling of transportation means (Group 7)
(Using ship’s cranes to load/unload from ship to the port’s warehouse/yard)

- Second-hand 4-seat vehicles and light trucks under 1.5 T: USD 50/unit
- New touring vehicles from 8 seats to under 15 seats, forklift truck under 5T, 20’ trailer:  USD 55/unit 
- Vehicles of 15 to 30 seats, trucks under 7T, Refrigerator trucks of 5T or under: USD 65/unit
- Trucks of 7T to under 15T, forklift trucks ≥ 5T,
Trailer 40’:  USD 70/unit

    • Refrigerator trucks > 5T, trucks of 15T-20T:                   USD 110/unit
    • Vehicles of above 30 seats:                                              USD 150/unit
    • Concrete-mixer trucks, tank trucks, crawler trucks,
      excavators and other specialized vehicles not mentioned above:
      + Under 15T:    USD 110/unit
      + From 15T to under 20T: USD 150/unit
      + From 20T to 30T: USD 250/unit
      + Above 30T:  negotiated ratesHandling from ship to cargo owners’ transportation means by ship’s cranes (or vice versa): decrease 10% of the rates of handling from ship to the port’s warehouse/yard, using ship’s cranes.

- In case of handling from ship to yard by habour cranes: increase 30% of the rates of handling from ship to the port’s yard using ship’s cranes

Transportation means, vehicles, rolled-wheel equipments are not in operation (due to no battery power, breakdown …) having to use the port’s tractors/forklift trucks to transport to the port’s warehouse/yard: 30% of the rates of mentioned above

Charges on handling self-movable transport means (except crawler trucks) from ship to yard (for RORO ship): 50% of the rates of handling from ship to the port’s warehouse/yard using ship’s cranes.
- Transport means with self-movable wheels (transport under Liner terms from ship to cargo owners’ transport means): 50% of the rates of handling from ship to the port’s warehouse/yard by ship’s cranes.
- For transport means piled up, charges on vehicles lying above is equal to 50% of the rates applied for those vehicles in III / 1.5

1.6 Charges on handling over-sized / over-weighed cargoes:

Unloading from ship to cargo owners’ transport means or wharf (or vice versa) using the port’s cranes:

    • Above 30MT to under 40 MT                          : USD 500/package
    • From 40 MT to under 50 MT                           : USD 700/package
    • From 50 MT to under 60 MT                           : USD 1,400/package
    • From 60 MT to under 70 MT                           : USD 2,000/package
    • From 70 MT and above                                   : agreed rates

Unloading from ship to customers’ transport means or wharf (or vice versa) using the ship’s derricks: 80% of the above rates.
- In case of connecting cranes for handling: increase 50% of the rates of handling
- For trucks moving from the wharf to the port’s warehouse/yard: agreed rates
- Delivery from warehouse/yard to customers’ transport means (using forklift trucks/cranes): 50% of the rates in III – 1.6

2/ Rates of tallying, delivering / receiving cargoes:

- The rates in 3.1 are inclusive of delivering/receiving rates
- Rates of handling containers stuffed with dangerous cargoes: increase 50% of the rates in 3.1
- Charges on handling over-sized containers, cont. 45 feet: increase 50% of the rates of handling container 40 feet.

 

3.2 Other services:
3.2.1 Handling/shifting transshipment containers: (Unloading from ship to yard and then loading on board of another ship in the same port): 150% of the rates of handling from ship ↔ the port’s yard, of which:

  • Unloading from ship to the port’s yard: 75% of the rates of ship ↔ yard
  • Loading on board of ship from yard: 75% of the rates of ship ↔ yard

3.2.2 Handling/shifting containers in the same hold: 25% of the rates of ship’s hold ↔ the port’s yard
3.2.3 Handling containers from one hold to another hold of the same ship (no through wharf): 55% of the rates of handling ship’s hold ↔ the port’s yard
3.2.4 Handling/shifting containers in the same ship (unload from ship onto shore and load back on the board of the same ship): 100% of the rates of the handling mode “Ship’s hold ↔ the port’s yard”
3.2.5 Handling containers of dangerous cargoes: 150% of the rates of container handling.

5/ Charges on storage/hiring warehouses/yards:
5.1 Rates of storage (basic unit price)

- Storage in warehouses:

+ Vehicles of 4 to 15 seats, light truck under 1.5 MT     : USD 4.50/unit-day

Notes:
-
Duration to be charged for storage is from the first ton of batch of cargoes stored in the port’s warehouse/yard. The quantity to be charged for storage is based on the actual cargo quantity stored in warehouse/yard.
- The basic unit price is applied for the first 30 days, if the duration is more than 30 days, the rates shall be charged as follows:

    • From the 31st to the 45th day     : increase 30% of the basic unit price
    • From the 46th to the 60th day    : increase 50% of the basic unit price
    • From the 61th day on                : increase 100% of the basic unit price

5.2 Rates of hiring warehouse/yard as lump sum price: to be agreed between the port and cargo owners.

7/ Charges on hiring means/equipments:
7.1 Engage by timing: (the minimum hiring time is 2 hour/unit of means)

  • Forklift truck above 10MT to 20 MT                   : USD 40/hour
  • Forklift truck above 20 MT                                 : USD 60/hour
  • Trimmer/dozer, excavator                                    : USD 15/hour

c). Hiring of floating cranes and barges:

  • Floating crane (not include towing)                       : USD 200/hour

(In case of cargoes more than 30 MT weight or 20 meter length: negotiable price)

  • Tugboat towing floating cranes                             : USD 1,000/trip

(Applied in the area of Saigon port, beyond the area the rate agreed)
7.2 Engage by weighing unit:
a). Hiring of cranes:

  • For cargoes group 1, group 2, group 3                 : USD 1.00/ton
  • For cargoes group 4, group 5                              : USD 1.50/ton
  • For cargoes group 6                                            : USD 2.00/ton

b). Forklift trucks for trimming cargo in hold, on wharf side: USD 0.80/ton
c). Trucks for transporting cargo in the port’s area:

  • Conventional cargoes                                           : USD 0.80/ton
  • Oversized/over-weighed cargoes                         : agreed price

7.3 Hiring of other means/equipments or other services not mentioned above:
Rates shall be agreed between the port and its customers for each specific case.
